Welcome to the Xerpihan platform. PT Xerpihan Kata Digital ("Xerpihan", "We", "Us", "Our") provides AI-powered content operations (Xerpihan Studio), and—through separate service and order flows—project-based professional language and content services (translation, proofreading, subtitling, transcription, full-service content production, and related offerings). By accessing or using our platform, you agree to be bound by these Terms of Service.

• "Platform": The xerpihan.com website and all associated dashboards, APIs, and Cloud Run services.
• "Content Assets": Any digital materials (text, video, audio, images, carousels) uploaded, generated, or processed on the platform.
• "Brand Assets": Logos, images, 3D models, and other visual materials uploaded via Brand Builder for use in AI content generation.
• "Creative Center": The AI content creation features including image, video, carousel, and blog generators.
• "Colab Market": The collaboration marketplace for discovering other brands/creators and proposing content cross-posting.
• "Market Intelligence": The AI-powered content planning and market research service, including Content Calendar, Fast Plan, and Deep Plan.
• "Connected Accounts": Third-party social media accounts (Instagram, TikTok, YouTube, X/Twitter, LinkedIn) you connect to the platform via OAuth.
• "Managed & Language Services": Project-based professional services outside the core self-serve subscription, as described in Section 8, including work performed by our specialist network (e.g. translators, editors, production) pursuant to applicable orders, contracts, or statements of work.

Eligibility & Registration

You must be at least 18 years old to create an account. You warrant that all information provided during registration is accurate and current.

Onboarding & Business Information

During onboarding, you may be asked to provide business information including industry, business description, target markets, website URL, social media URLs, content language, and visual references. This information is used to personalize content recommendations and market strategies. You are responsible for the accuracy of the information provided.

Enterprise Profiles

Enterprise users may undergo a verification process ("Verified Profile") to unlock advanced governance features. The PIC (Person in Charge) is responsible for all team activities within that workspace.

Profile Visibility

By completing onboarding, you agree that your basic profile information (name, photo, industry, topic, and business description) may be visible to other users in the Colab Market for discovery and collaboration purposes.

AI Model Providers

The Creative Center uses AI models from multiple providers, including but not limited to Google (Gemini, Imagen, Veo), Anthropic (Claude), and OpenAI (GPT). Availability of specific models may change at any time. Use of these models is subject to each provider's terms of service.

Content Generation

The Creative Center enables you to create various content types including images, videos (including short-form videos/Reels/TikTok/Shorts), carousels, and blog posts. The creation process may involve:

• An AI chat agent that processes your instructions and revisions.
• Use of your Brand Assets (logos, images, 3D models) as visual inputs.
• Generation of frame pairs (first/last frames) for video production.
• Automated video creation from selected frames using video generation models.
• Platform-specific content templates and styles (short-form video hooks, transitions, text overlays).

Inputs & Outputs

You are solely responsible for the inputs (prompts, instructions, attachments) you provide. Xerpihan does not guarantee the accuracy, completeness, or usefulness of the results (outputs) generated by our AI systems. AI-generated content may require human review and editing before publication.

AI Usage Rights

We grant you commercial usage rights for content generated through the Creative Center, subject to compliance with applicable copyright laws in your jurisdiction and the licensing terms of the underlying AI model providers.

Content Calendar & Strategy Planning

The Market Intelligence service provides AI-powered content planning through the Content Calendar. Two planning modes are available:

• Fast Plan: Quick content plan based on your business information and current trends.
• Deep Plan: In-depth 30-day research analyzing your website, social profiles, YouTube trends, and Google Search data to produce a comprehensive content strategy.

Data Sources & Analysis

To generate recommendations, Market Intelligence may access and analyze:

• Your website URL and social media profiles provided during onboarding.
• Public web data and social media metadata via Google Search grounding.
• YouTube trends and statistics via the YouTube Data API.
• Visual references you selected during onboarding or planning.

Nature of Recommendations

The insights and recommendations generated are statistical estimates based on AI analysis and should not be considered binding financial, legal, or marketing advice. Xerpihan does not guarantee the success or performance of content that follows our recommendations.

Scraping, automated extraction, or reselling raw data obtained from our intelligence reports without written permission is strictly prohibited.

Discovery & Visibility

By using the Colab Market, you understand and agree that the following profile information will be visible to other users who have completed onboarding: name, profile photo, industry, topic, business description, target markets, and social media URLs.

Collaboration Requests

When proposing a collaboration, your content metadata (title, platform, format, thumbnail, and caption snippet) will be shared with the recipient. The recipient may accept or decline the request. Approved collaborations may involve cross-posting content on the recipient's social media platforms.

User Responsibilities

• You are responsible for the truthfulness and originality of content submitted for collaboration.
• You may not use the Colab Market for spam, fraud, or promotion of illegal content.
• Xerpihan is not responsible for outcomes or obligations arising from collaborations between users.
• Any additional business agreements between collaborators are the responsibility of the respective parties.

Connecting Third-Party Accounts

The platform allows you to connect third-party social media accounts (Instagram, TikTok, YouTube, X/Twitter, LinkedIn) via OAuth protocols. By connecting an account, you authorize Xerpihan to:

• Access your profile information and account statistics.
• Retrieve analytics data (followers, reach, impressions, engagement).
• Access content libraries (posts, videos, stories) for analytics purposes.
• Publish content to connected accounts if you authorize that feature.

Platform Compliance

You are responsible for ensuring that your use of connected accounts complies with each platform's terms of service (Meta/Instagram, TikTok, Google/YouTube, X/Twitter, LinkedIn). Xerpihan is not responsible for any suspension or termination of your social media accounts by third-party platforms.

Revoking Access

You may disconnect social media accounts at any time through the dashboard settings. Once disconnected, Xerpihan will no longer access data from that account, although previously retrieved data may be retained in accordance with our data retention policy.

Scope

Without limiting future offerings, Managed & Language Services may include, among other things: translation, proofreading, subtitling, transcription, full-service content production, and other language or editorial services described on our service pages, order forms, written quotes, or order confirmations.

Orders, SLA & Governance

Specific terms (pricing, timelines, revisions, service levels / SLAs, security or compliance requirements, and deliverable rights) are binding to the extent set out in the applicable order, separate agreement, or agreed statement of work for that project. If there is a conflict between those documents and these Terms, the project-specific terms govern the same subject matter for the relevant order.

Specialist Network

To fulfill orders, we may assign specialists, contractors, or partners (including via team or assignment features on the platform) who process materials you provide only as needed to complete the work. You authorize Xerpihan to disclose such materials to those parties under confidentiality and appropriate-use obligations as set out in our Privacy Policy and applicable order terms.

Your Representations

You represent that you have the right to submit all materials provided for Managed & Language Services and that use and disclosure to specialists does not violate law or third-party rights. You are responsible for the accuracy of style guides, glossaries, and instructions you supply.

  Billing CyclesSubscriptions (Pro/Business) are billed in advance on a monthly or annual basis.

  AI CreditsAI Credits are consumed for content creation operations (images, videos, carousels, blogs) and strategy planning. Unused credits within a cycle may expire depending on the selected plan.

  Managed & Language Services (project-based)Payment for professional service orders (e.g. via order flows or quotes) is processed according to the terms stated at checkout, on the invoice, or in the contract for that project; this is separate from recurring Studio subscriptions.

  Refund PolicyAll purchases are non-refundable.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, XERPIHAN SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES ARISING FROM THE USE OF THE PLATFORM, INCLUDING BUT NOT LIMITED TO:

• Losses arising from AI-generated content that is inaccurate, misleading, or inappropriate.
• Failures or delays in third-party services (AI providers, social media platforms).
• Outcomes or obligations from collaborations between users on the Colab Market.
• Suspension or termination of connected social media accounts by third-party platforms.
• Inaccuracies in Market Intelligence recommendations or analytics.
• Disputes or claims arising specifically from contractual relationships between you and third-party specialists or partners, except where such liability cannot be limited under applicable law.

Our total liability shall not exceed the amount paid by you to us in the last 12 months.

We reserve the right to terminate or suspend your access to the Service immediately, without prior notice, if you breach these terms or if we detect suspicious activity on your account, including but not limited to:

• Abuse of AI APIs or attempts to circumvent usage limits.
• Use of the Colab Market for spam, fraud, or illegal activities.
• Automated scraping or data extraction from Market Intelligence services.
• Infringement of third-party intellectual property rights through the platform.

Upon termination, you may request an export of your data within 30 days. After 30 days, your data will be deleted in accordance with our data retention policy.
